Hydro Aluminium Extrusion Ltd, of Caerphilly, Mid Glamorgan has been found guilty of negligence at the workplace resulting in death of an employee.
The incident took place in November 2006, when a project engineer working with the company, Jens Hinrichs of Hexham was working at the HAE factory located on Chester-le-Street. He was working inside a shuttle line that took finished aluminium products from the packing stations to the banding machine. The stations led to the rail tracks that were used by shuttle cars for shifting of material. While Mr. Hinrichs was working in an enclosure at the site, he was hit by a shuttle car and fatally injured. He succumbed to his injuries before reaching the hospital.
The case was heard by Durham Crown Court that fined the company £100,000 with costs of £13,375.
Commenting on the case, Zoe Feather, HSE inspector, said that the accident was completely preventable given the employers had made the requisite assessment and implemented appropriate health and safety measures. She also added that the company should have ensured that people did not get easy access to the shuttle line, especially when the line was in work. If the area with the hazardous machinery had been properly isolated and the correct safety measures were in place, it could have saved a life. Ms. Feather also emphasized upon the need for conducting assessment of dangerous machinery and take precautions such as providing a safe entrance for the shuttle area, especially when it is being used.
According to Oliver Campbell of the Hydro Aluminium Extrusion Ltd, the company observes health and safety guidelines and it has already made efforts to improve the condition.
